This is a petition, in revision, against the appellate judgment of the Sessions Judge of Cuttack Dhenkanal maintaining the conviction of the petitioner under Sections 112 and 123 of the Motor Vehicles Act and the sentence of fine passed on him, by the Sub-Divisional Magistrate of Athmalik.2. The petitioner is the owner of public carrier vehicle bearing No. ORD-111. The route permit for the vehicle (Ext. 2) authorised the plying of the vehicle on the following routes, namely, (i) Cuttack-Sambalpur (ii) Angul-Hindol, (iii) Angul-Athmalik and (iv) Angul-Talcher during fair weather.On 9-3-1956 the said vehicle was found plying on the Bamur-Kishorenagar road, by the A.S.I. (P.W. 1). It was driven by one Alekhmoni Biswal. The Police Officer (P.W. 1) found five Muliahs (servants) in addition to the driver and the cleaner. Mohapatra, Subordinate Judge of Cuttack, dismissing the appeal on. a preliminary issue as the persons vitally interested in the appeal were not made party-respondents. 2. S.P. Mohapatra, J. 1. This second appeal has been filed by defendants 1 and 4 against the judgment of reversal dated 22-4-1954 of Sri R. C. Misra, District Judge of Sumbulpur arising out of a suit brought by the plaintiff for a mere declaration of his title to the property in dispute with an area of 25-84 acres appertaining to holding No. 9; the rental payable in respect of the holding being Rs. 6/12/- only. The cause of action for the suit is the order of attachment under Section 146, Criminal Procedure Code, dated 5-3-1951, arising out of proceedings under Section 145 of the said Code started at the instance of the present appellants. This is a plaintiffs' second appeal against the reversing judgment of the lower appellate Court arising out of a suit for declaration of title On the basis of a purchase of the disputed land with an area 0.42 acre out of the total acreage of 0.66 appertaining to Plot No. 901 and for confirmation of possession. The plaintiffs' version is that Luxmidhar Mohanty was the original ancestor of the parties to whom the property belonged. Luxmidhar had three sons: Chakradhar, who died a bachelor prior to the final publication of the Current Settlement record-of-rights Dinabandhu (defendant No.1) and Krupasin-dhu, the deceased husband of Kshetramoni (defendant No. 4). Luxmidhar died prior to 1930, and his widow died on 21st January 1949. Krupasindhu however had died in the year 1940 leaving behind him his widow Kshetramoni. This is a reference by the Sessions Judge of Sambalpur for confirmation of the sentence of death passed on the appellant Basanta Bag for having committed murder of a boy aged four years in Sambalpur town on 17-3-1958. The deceased whose name was Prakash Chandra Varma alias Babu was the son of one Janardan Presad Varma (P.W. 3) a teacher of Sambalpur Zilla School.
