Dharmadhikari, J.1. All these writ petitions were heard together as they involve common question of law and fact and. therefore, are being disposed of by this common judgment.2. In all these writ petitions, the first proviso to sub-section (3) of Section 27 of the Maharashtra Co-operative Societies Act. as amended, is challenged on various grounds. In Writ Petition No. 3952 of 1984, Respondent No.6 the Nasik District Central Co-operative Bank Ltd., Nashik - is a co-operative society duly registered under the Act. It is also a Central Co-operative Bank within the meaning of the said expression as defined in section 2(6) of the Act. It is an apex co-operative bank for the Nasik District. 1. Military Crane No. 430143 having developed trouble, was being towed by a military tractor driven by defendant 4 Gurucharansing Bhaktawarsingh Sikh, from Dapodi to Poona. The plaintiff Sadashiv Vaikar's son Sham was also proceeding towards Poona from Fugewadi on his bicycle. A narrow bridge called Harris Bridge was a mute witness to an accident between the cyclist Sham and the military tractor diver, and according to the parents of the cyclist the military drivers were negligent in driving their vehicles as a result of which Sham was fatally knocked down by the tractor and the Crane, Sadashiv Vaikar filed Special Civil Suit No. 32 of 1971 in the Court of the Civil Judge, Senior Division, Poona, which decreed the claim of Rs. 10,000/- with interest. P.B. Sawant, J.1. The petitioner, who hails from the State of Kerala, had applied for one of the posts of the Auditors (U.D.C.) advertised by the Director of Audit, Defence Services, in June 1971. He appeared for the written test held for the said post in May, 1972 and having successfully passed in the same, received a call for interview on the 29th September, 1972. Admittedly, the petitioner had secured higher marks than respondents 5 to 20 who hail from States other than Kerala. It however appears that although respondents 5 to 20 were appointed to the posts of Auditors with effect from 24th September, 1973, the petitioner's appointment was delayed till 13th March, 1974 on which date, for the first time, he joined his duties as such Auditor in the office of the Senior Deputy Director of Audit, Pune-respondent No. 4 herein.
