ORDERGokhale (Chairman)1. These two petitions have been filed under section 155 of the Companies Act, 1956, which shall hereinafter be referred to as the Act. Petition No. 9 is by one Navinchandra Ratilal Patel for rectification of the register of members of respondent No. 1 company, Gordhandas Desai Private Limited, which shall hereinafter be referred to as the company. Navinchandra has prayed that 300 shares bearing the distinctive numbers 4399 to 4698 which at present stand in the name of Gordhanbhai Ishwarbhai Patel should entered in his name and the register of members rectified accordingly. In Petition No. 10 of 1966, he petitioner is Prafulkumar Ratilal Patel. Patel, J.(1) These three civil applications arise out of action of the State Government under the Grant-in-aid Code for Secondary Schools.Civil Application No. 420 of 1966.(2) Petition No. 1 is s Society registered under the Societies Registration Act of 1860 at Anjansinghi, Taluka Chandur, District Amravati, and petitioner No. 2 is its President. The Society made an application for permission to open a Secondary School, and it was proposed to start in the first year 9th class, as there was sufficient arrangement in the village for education up to standard VII in the Zilla Parishad schools. First such application was made in 1963, which was rejected by respondents 1 and 2, Second was made in 1964 which met a similar fate. The Society made another application on October 30, 1965. Abhyankar, J.(1) This petition under Article 227 of the Constitution is filed by the President of a Co-operative credit society styled as Nagar Palika Prathamik Shala Shikshak Servants Co-operative Credit Society. Buldana. The petitioner challenged the legality of the orders of the second and third respondents in purported exercise of their powers under the Maharashtra Co-operative Societies Act (Maharashtra Act No. XXIV of 1961).(2) A few facts giving rise to this petition may now be noticed. The petitioner society has been registered under the Maharashtra Co-operative Societies Act, 1960, and consists of 25 members. The Society is a co-operative credit society for the benefit of primary school teachers employed in the Municipality at Buldana. The first respondent Shri R.D. Umalkar, is apparently the Headmaster of Primary School No.2 run by the Buldana Municipal Committee.
