Feeling aggrieved by the order passed by the first Appellate Court remanding the suit with a direction to the trial Court to get the certified copy of the registered sale deed executed on 24th July, 1973, and registered on the same date, exhibited and after affording sufficient opportunity to the appellant to lead evidence and permitting the plaintiff to cross-examine him; decide the suit afresh on merits; the defendant/tenant has now approached this Court seeking redress praying for reversal of the impugned order.2. I have heard the learned counsel for the defendant/tenant-appellant as well as the learned counsel representing the landlord/respondent, and have carefully perused the record.3. The facts in brief shorn of details and necessary for the disposal of this appeal lie in a narrow compass. The plaintiff/landlord-respondent had filed the suit on 13th December, 1989, seeking a decree for recovery of possession over the accommodation in dispute under the ...

S.P. Srivastava, J.1. The claimant-appellant feels aggrieved by the order passed by the Motor Accidents Claims Tribunal rejecting his application seeking payment of an amount of Rs. 15,000 as interim compensation under Section 140 of the Motor Vehicles Act, 1988 in respect of his disablement claimed to have resulted from an accident arising out of the use of the offending motor vehicle bearing registration No. MP-04-H-7089 and has come up in appeal seeking redress.2. A petition was filed claiming Rs. 11,52,841 as compensation.2. Before the Tribunal, evidence was led and the statement of Rajeev Kumar Dubey, PW 4, who is a Sergeant in the Air Force, is to the effect that the deceased was getting Rs. 2,336 per month. The certificate issued by the office in that regard was also exhibited as Annexure P/3. The learned Tribunal on considering the future prospects of the deceased had determined his income at Rs. 3,000 per month. The deceased was aged 31 years at the time of his death. The learned Tribunal applied the multiplier of 16 in order to determine the amount of compensation. Thus, the sole controversy circles around the dependency of the claimants on the income of the deceased. The learned Tribunal has determined the dependency at Rs. 1,500 per month. The deceased h...
