Appellant/defendant feels aggrieved by the judgment and decree dated 4.1.1989 passed by I Additional District Judge, Satna in Civil Suit No. 15-B/1983 and challenges legality and validity thereof in this first appeal under Section 96 C.P.C.2. The respondent/paintiff had filed the present suit for recovery of Rs. 18002-76p. together with interest at the rate of Rs. 2/- per hundred per month and notice charge totalling Rs. 24,027-73 p. being the amount due to him, on account of tyres obtained by the appellant. The respondent/paintiff Claimed a decree for Rs. 24,000/- only. According to the respondent/paintiff, M/s. Vikrant Tyre Limited, Indore had handed over to them tyres for delivery to the appellant on various dates in the year 1980. The respondent/plaintiff had handed over receipts to the said Company, which were to be produced at the time of delivery.
