Tankha, J.This appeal has been filed by appellant Mahendra alias Mishrigiri against his conviction under Section 302 of the Indian Penal Code and sentence of imprisonment for life passed by the Second Additional Sessions Judge, Indore, vide his judgment dated 25th May, 1972 in Sessions Trial No. 42 of 1972.2. The brief facts of the case as alleged by the prosecution are that on 18-11-1971 at about 10 or 10-30 p.m. deceased Govindram accompanied by Omprakash (P.W. 1) and Wamanrao (P.W. 2) went to Metro Hotel in Indore City for taking their dinner. On reaching the hotel, they were directed by the proprietor of the hotel, Saidas (P.W. 3), to go on the first floor as there was no room in the hall of the said hotel. The relevant facts are that Motilal Jain is a karta of the Hindu undivided family known as ' Khubchand Motilal of Seoni' (hereinafter referred to as 'the assessee'). He has six sons. No partition of the Hindu undivided family assets has taken place and all the members of the family are staying jointly. Rajendra Kumar is an adult coparcener of the family. He entered into a partnership with one Gulabchand Sohaney in the business, known as ' Rajendra Medical Stores ' for which a partnership deed was executed on September 1, 1958, and both the partners agreed to share the profits and losses equally. The terms of the partnership were that Rajendra Kumar would invest up to Rs. 20,000 in the beginning of the business and if further amount would be required, Rajendra Kumar will manage for the same. Indore, rejecting their claim for compensation for the death of two of the passengers, Jinendra Kumar and Basantilal, arising from ,a motor accident.2. The material facts, shortly stated, are as follows:--On the 13th February, 1965, there was a ghastly accident on the Mortakka Bridge over the Narbada resulting in the tragic death of eight persons. It is as very large bridge, having a length of 2600 ft. with twenty-four spans each of 108 ft.
