ORDERBishambhar Dayal, C.J.1. This is a petition by Ram Sahai Pandey under Article 226 of the Constitution against an order passed by the State Industrial Court.2. The facts which are not in dispute may shortly be stated. One Sabir AH was elected as president of the Rashtriya Mill Mazdoor Sangh (hereinafter referred to as the union). His election was challenged by respondent No. 2, Deoram before the Industrial Court under Section 28J of the Trade Unions Act, 1926, as amended in this State. During the pendency of those proceedings, Sabir Alt died and the present petitioner Ram Sahai claims to have been elected as president of the union on 25th April, 1971. By order dated 4th August, 1971 the Industrial Court held that the reference against Sabir Ali had abated as he had died and no further orders could be passed. Tare, J.1. This order shall govern the disposal of Misc. (First) Appeal No. 209 of 1970, (Pannalal Malviya v. The Heavy Electricals Ltd. Bhopal) also. These appeals are directed against the same order (wrongly described as a judgment) dated 3-9-1970, passed by the Third Addl. District Judge, Bhopal in Civil Suit No. 1-A of 1970.2. The Heavy Electricals Ltd., which is a Government undertaking, but which is a separate corporation having its separate legal entity, gave a contract for the work of filling certain area. Under the agreement the contractor was to be paid 3% above the rate of Rs. 00.80 paise per cubic meter for morum or sand spreading, including dressing 50 meters lead, and 1.5 meters free lift The extent of work done as also the rate at which the payment was to be made were points of dispute between the parties. Raina, J. 1. This is an appeal under Section 202 of the Companies Act, 1913. 2. The facts which give rise to this appeal, briefly stated are as follows:-- In Civil Suit No. 14 of 1927 in the Court of Sub-Judge, First Class, Chhindwara, Amalgamated Coal-fields Company obtained a decree against M/s. Raisaheb Hiralal Verma and Munshi Kanhaiya Lal Ltd. During proceedings in execution of the decree, the decree-holder applied for appointment of a receiver in respect of Junnardev Colliery No. 2 which belonged to the judgment-debtor. This application was opposed by Hasanali-Abdul Ali, creditor of the judgment-debtor company on the ground that there was an existing arrangement between him and the judgment-debtor company which would be adversely affected.
