Dixit, C.J. 1. This is a reference under Section 256(1) of the Income-tax Act, 1961 (hereinafter referred to as the Act) at the instance of the Commissioner of Income-tax. Madhya Pradesh, Nagpur and Bhandara The question which has been propounded by the Tribunal for our decision is:-- 'Whether the sum of Rs. 24,341 was liable to lax under Section 41(1) of the Income-tax Act 1961?' 2. The material facts are that one Kanhaiyalal used to carry on business as selling agent of Messrs Mohanlal Hargovinddas of Jabalpur under the name and style of 'Messrs Hukumchand Mohanlal'. On or about 17th February 1960 Kanhaiyalal died His widow Hira Laxmi succeeded to the business of selling agent carried on by her husband and continued it under the same name and style, namely. 'Messrs Hukumchand Mohanlal'. The firm of Mohanlal Hargovinddas had recovered from Kanhaiyalal an amount of Rs. 24.341 as sales tax for transactions effected during the period from 26th January 1950 to 31st March 1951. DIXIT C.J. - This is a reference under section 56(1) of the Income-tax Act, 1961 (hereinafter referred to as the Act), at the instance of the Commissioner of Income-tax, Madhya Pradesh, Nagpur and Bhandara. V.R. Newaskar, J.1. Appellants Bhuwan and Nakdiya were prosecuted before the Additional Sessions Judge, Alirajpur, for the murder of Ramsingh on the 14th of April 1965 at the village Bardala. They were found guilty, the former under Section 302, I.P.C. and the latter under Section 302 read with Section 34, I.P.C. and were sentenced to life imprisonment.2. Both appealed. The circumstances in which this application under Articles 226 and 227 of the Constitution has been filed are that on 10th January 1955 the Nyaya Panchayat, Nagod, made an order for the allotment of a piece of land lying in the area of the Gram Panchayat, Nagod, to the petitioner on his paying a certain Nazarana. The petitioner paid the Nazarana and secured the land. Thereafter, according to him, when he commenced the construction of a house on the plot, the Patwari reported to the Assistant Collector Satna, that the applicant had encroached upon the land. On this report, the Assistant Collector directed the Tehsildar to initiate proceedings for cancellation of the order of allotment. This order of the Assistant Collector was, however, ultimately set aside by the Board of Revenue on 15th July 1959.2.
