This is a reference under Section 27 of the Wealth-tax Act, 1957, by the Income-tax Appellate Tribunal, Allahabad Bench, at the instance of the assessee, Gajadhar Prasad Nathu Lal Of Satna. The question referred to us for decision is:'Whether, under the Wealth-tax Act, the value of ancestral property is assessable in the hands of the sole surviving coparcener, whose family consists of wife and daughter, in the status of an individual ?'2. The assessee has filed an application for being permitted to withdraw the reference saying that he is no longer interested in 'prosecuting the reference'. Shri Tankha, learned counsel appearing for the assessee, also prayed that the assessee be allowed to withdraw the reference. By this petition under Articles 226 and 227 of the Constitution the petitioner seeks a writ of certiorari for quashing an order of removal, dated 29th December 1964, passed by the Divisional Superintendent, Central Railway. Bhusawal. as also an order dated 7th August 1965. passed by the Chief Engineer. Central Railway. Bombay, in appeal confirming the order of removal.2. During the relevant period, the petitioner was in charge of a Construction Depot of the Central Railway at Itarsi as a Store-Keeper-cum-Senior Clerk Shri C.S Patankar, Assistant Engineer, Itarsi. was his immediate superior. It appears from the record that on 27-5-1961 a truck carrying about 100 bags of cement was checked by the Station House Officer, Itarsi, on suspicion that the cement belonging to the Railway Administration was being carried away surreptitiously. By this application under Articles 226 and 227 of the Constitution the applicant prays for the issue of a writ of certiorary for quashing the decision of the Sub-Divisional Officer, Bilaspur, rejecting an election petition filed by the petitioner challenging theelection of the respondent No. 1 Brijlal as a co-opted member of Gram Panchayat, Ratanpur.2. The election to the Gram Panchayat was held on 4th January 1965. As no Chairman of any Co-operative Society in the Gram Sabha was elected as a member it became necessary to co-opt a Chairman of a co-operative Society functioning in the Gram Sabha as laid down in Section 11 (3) (ii) of the Madhya Pradesh Panchayats Act, 1962. A meeting of the elected panchaa for making this co-option was convened on 26th January 1965.
