Newaskar, J.1. Respondent Mangu s/o Kishan Bagri of Harnavda was prosecuted before the Sessions Judge, Ujjain, for the murder of his cousin Sukhram on 31-1-1965 at the village Harnavda. He was found guilty not under Section 302 I. P. C. but only under Section 304 (Part II) I. P. C. and was sentenced to three years' rigorous imprisonment. The respondent did not prefer any appeal against his conviction. The State, however, has preferred the present appeal against his acquittal in respect of the charge under Section 302 I. P. C.2. The incident in the course of which Sukhram lost his life arose over a petty matter. The respondent had borrowed Rs. 2/-from him about a year prior to the date of the incident. On the date of the incident i.e. 31-1-1965 the accused had gone to the river Chambal for bathing. Shiv Dayal, J.1. This second appeal arises from a suit for ejectment of a tenant. The trial Court passed a decree in favour of the plaintiff. The same has been affirmed by the first appeal Court.2. The appellant is in occupation of a portion of House No. 41 in Napier Town, Jabalpur. In pursuance of the powers conferred under Section 20 of the Displaced Persons (Compensation and Rehabilitation) Act of 1954 (Act No. XL of 1954) (hereinafter called 'the Act') the house was sold to one Bhagwandas. A sale-certificate was issued to the said purchaser on 8 December 1961. That certificate of sale declared the said Bhagwandas to be the purchaser of the said property with effect from 15th day of June 1957. Bhagwandas in his turn sold the house to the plaintiff by a registered deed of sale dated 5 March 1962. 1. The petitioner is a manufacturer of boot polish and is a registered dealer under the Madhya Pradesh General Sales Tax Act, 1958. The boot polish manufactured by him is packed in different sizes of tin-dibbies and the said dibbies are enclosed in cartons made out of box-board or gray-board. Similarly, the boot polish manufactured by the petitioner is covered with aluminium-foils after the same is filled in the dibbies. The petitioner applied before the Sales Tax Officer, Circle II, Gwalior, for inclusion of the tin-plates, labels, aluminium-foils, box-board and gray-board in the registration certificate on the ground that these articles were utilised by him as raw materials in the manufacture of the boot polish. It is the claim of the petitioner that the tin-dibbies and the cartons are manufactured by him in his own factory. P.K. Tare, J.1. This is an appeal by the defendant against the decree, dated 29-6-1962, passed by the II Addl. District Judge Durg, in Civil Appeal No. 11-A of 1962, modifying the decree, dated 8-1-1962, passed by the Civil Judge Class II, Bemetara, in Civil Suit No. 54-A of 1959.2. The appellant is the step son of the respondent. The appellant's father, Shivcharan held certain properties shown in Schedule B attached to the plaint and Schedule A which had been filed with the plaint, but now which is annexed to the decree of the trial Court as family properties. In the year 1937-38, Shivcharan effected a partition between himself and his son whereby the property mentioned in Schedule A was allotted to the father, while the property mentioned in Schedule B was allotted to the appellant.
