1. This appeal is against the decision of the Additional District Judge, Umaria, in civil suit No. 54 of 1954, decided on 30th December 1955. The plaintiff is the appellant whose suit for Rs. 5000/- against the two defendants failed in the Court below. 2. According to the plaintiff, a sum of Rs. 5000/- was borrowed by the two defendants on the 15th June 1952. He produced in support of his case his own account books' showing an entry to that effect. The defendants denied the loan and their case was accepted in the Court below. 3. In this appeal the short question is whether the plaintiff had succeeded in proving his case. No doubt, the account books were produced, but the munim, who wrote them, was not examined. Under Section 34 of the Indian Evidence Act, account books by themselves cannot be sufficient and therefore some other evidence was necessary. M. Hidayatullah, C.J. and B.K. Choudhuri, J. 11. This is a Letters Patent Appeal from an order of Bhutt, J. in Miscellaneous Petition No. 552 of 1956, decided on 21st February, 1957. 12. The State Government declared the area under the Notified Area Committee, Kareli to be a municipality in the year 1948 under Sub-section (2) of Section 5 of the Central Provinces and Berar Municipalities Act, 1922 (hereinafter referred to as the Act). Subsequently the Municipal Committee, Kareli was dissolved by the State Government under Sub-section (1) of Section 57 of the Act by an order dated 24th June, 1950. Thereafter, a fresh election of the members and president of the Municipal Committee was held in 1953, and a new Committee was constituted. On 3rd September, 1956 the State Government served a notice on the Committee framing certain charges against it and asking it to show cause why it should not be superseded. In this case an. award was made in favour of the Indore Paraspar Sahakari Pedhi, Ltd., Indore, under Section 60 of the Gwalior State Co-operative Societies Act, Samvat 1997, as extended to the entire State of Madhya Bharat by Act No. 45 of 1949. The award was made by the Registrar and was against the respondent before us. An application for the execution of the award was made by the appellant Society in the Court of Additional Civil Judge, First Class, Indore.The respondent raised the objection that the award not having been transferred to the Civil Court by the Government Inspector, Cooperative Societies, for execution, the Court had no jurisdiction to entertain the application for execution of the award. This objection was accepted.
