ORDERDixit, J.1. The petitioner Gopiram has been convicted by the Sub-Divisional Magistrate, Gwalior under Section 408, Indian Penal Code and sentenced to rigorous imprisonment for six months and a fine of Rs. 50/- in default, rigorous imprisonment for one month. He appealed to the Sessions Judge, Gwalior and his appeal was dismissed. He has now come up in revision to this Court.2. The material facts are that the applicant Gopiram was an assistant cashier in Gwalior Sugar Company Ltd., Dabra. The prosecution wit-ness Raghuwar Swaroop Bhatnagar was a cashier in the company. From 27th June 1951 to 30th June 1951 Raghuwar Swaroop Bhatnagar was on leave. During his absence Gopiram worked as cashier and in that capacity he received on 28th June 1951 Rs. 238/15/6 from the Co-operative Stores of the Sugar Company for being credited in the account of the stores. ORDERDixit, J.1. This case has been submitted by the Sub-Divisional Magistrate, Chachora to this Court under Section 341, Criminal P. C. The material facts are that the accused Genda who is a deaf and dumb man was charged before the Sub-Divisional Magistrate under Section 326, I. P. C. for having cut the nose of his wife Gendi and also the nose of one Nathua on 9-8-1953. Along with Genda, Hazari, Umariya, Panna, Laxminarayan and Gorelal were also charged for having abetted the offence committed by Genda, After recording the evidence of some prosecution witnesses, the Sub-Divisional Magistrate framed a charge against Genda for an offence under Section 326, I. P. C. He also framed charges against the other accused for offence under Section 326, I. P. C. read with Section 34. Samvatsar, J.1. The accused were on inimical terms with one Jaganath now deceased & there were some disputes going on between them before the Revenue Courts. On 13-7-1952 the deceased Jaganath was working in a field which belonged to the accused Keshya and was taken by the deceased in lieu of his debt. The deceased was working in the field since mid-day assisted by his servant one Shankar Chamar. When both of them were returning from the field in the evening and were crossing a nala on the way they were attacked by the three accused with lathies. Shankar ran away but Jaganath was mercilessly beaten and sustained .12 injuries which included a compound depressed, fracture of the left temporal bone. Jaganath died as a result of these injuries on the following day.2. Upon these facts the three accused along with two other persons were put up for trial under Sections 302/149/147, I.P.C.
