ORDERSamvatsar, J.1. The applicant Yadavrao executed a surety bond for Rs. 600/- on August 10, 1951 for one Rameshchandra, who was put up for trial under Section 379, I.P.C. before the Railway Magistrate, Indore. As Rameshchandra, the accused failed to appear in Court on 30-8-1951, which was the date of hearing, a notice was issued to the surety to show cause why the surety bond should not be forfeited. On 19-10-1951 the surety applied to the Court for a warrant of arrest against the accused alleging that he had absconded. The prayer of the surety Was granted and a warrant was issued to arrest the accused. Thereafter neither the accused nor the surety appeared before the Court and the trial Court ordered the surety bond to be forfeited. The surety appealed to the District Magistrate against the order forfeiting the surety bond but the appeal Was dismissed. ORDERNevaskar, J.1. Accused K. N. N. Ayyangar was prosecuted under Section 161 I. P. C., before the Additional District Magistrate, Railway Lands, Mr. B. R. Dube on a challan submitted by the Delhi Special Police Establishment, Jabulpur. The said Magistrate found the accused guilty under that section and sentenced him to rigorous imprisonment for two years and a fine of Rs. 7000/-.2. Accused preferred an appeal against this decision which was heard by the Second Additional Sessions Judge, Indore who maintained his conviction but reduced the sentence of imprisonment from two years to six months and of fine from 7000/- to Rs. 1000/-.3. ORDERNevaskar, J.1. Accused Mohan and Gajanan residents of Kasrawad were prosecuted before the Sub-Divisional Magistrate, Mandleshwar for offences under Sections 325/109, 342 and under Sections 325, 342, I.P.C., respectively who found them guilty for these offences and sentenced both the accused to six months' rigorous imprisonment and a fine of Rs. 200/- each under Section 342, I.P.C. and sentenced accused No. 1 under Section 325/109, I.P.C. to twelve month's rigorous imprisonment and a fine of Rs. 200/- and accused No. 2 under Section 325/109 to eighteen months' rigorous imprisonment and a fine of Rs. 200/-.
