This is an application for waiver of predeposit of duty of Rs.12.31 Crores and penalty of Rs.1.50 Crores imposed under Rule 173Q of the erstwhile Central Excise Rules, 1944 and Rule 25 of the Central Excise Rules, 2002. 2. At the outset, the ld.Sr.Advocate appearing for the Applicant, has submitted that this is second round of litigation before this Tribunal. The Applicants are engaged in the manufacture of greig fabrics. The said goods were captively consumed in their factory in the manufacture of their final product, namely, synthetic wire cloths under Chapter Heading 5909.11 of CETA, 1985. The ld.
