1. The Special Officer visited the tea estate in terms of my order dated 14th March, 2011. He has duly filed a report, which is taken on record. I gave an opportunity to the parties to take exception to the report. No exception has been taken. According to such report, the green leaves sold between 3rd April 2009 and 31st December 2009 was 21,84,773 Kgs. Some of the tea were sold by the respondent to the petitioner. But most of it were not, according to the case of the petitioner. 2. The claim of the petitioner is a little over Rs.1 crore. Two clauses in the agreement are very crucial for grant of an interim order in this application. The first is the negative covenant restraining the respondent from selling the green tea leaves to any other party except the petitioner unless and until their dues were satisfied.
