ORDERAnil Kumar Sen, J.1. The subject-matter of challenge in both these two Rules is the same resolution viz., the one dated July 2, 1969, adopted by the Regional Transport Authority, Burdwan extending the five Stage Carriage permits of the Durgapur State Transport Board to Burdwan Court from Keshabgunj-Chatti. The petitioner in one case is the Burdwan District Bus Association and in the other is Sri Ajitava Chakraborty both of whom raised objections against such extension and whose objections had been overruled. The subject matter of challenge being the same and the challenge being based on common grounds these two cases have been heard together and are being disposed of by this judgment. Debiprasad Pal, J.1. Sri Bindeshwari Singh, the respondent No. 4 in this petition was an employ of the petitioner-company. On 22nd November, 1966, he met with an accident and was admitted to the I.S. Hospital, Chinsurah, District Hooghly, He was duly plastered and discharged from the hospital, Subsequently he was placed under the treatment of Dr. K.L. The respondent No. 3, the Trustees for the improvement of Howrah prepared a General Improvement Scheme under Section 33 (2) of the Howrah Improvement Act, 1956 (hereinafter referred to as the said Act)covering various areas in the erstwhile Ward No. 6 of the Howrah Municipality.
