U.C. Law, J.1. The plaintiff has brought this action for recovery of sum of Rs. 1,80,414/- against the defendants as guarantors. The facts out of which this action arises shortly as follows:2. A company known as the Central Jute Co., Ltd. having its registered office at Narayanganj in East Pakistan (to be called hereafter as the Company) maintained an overdraft account with the plaintiff then carrying on business of banking in the name and style of National Bank of India Ltd., Narayanganj Branch. Subsequently, the name of the plaintiff bank was first changed to National Overseas and Grindlays Bank Ltd, with effect from 1st January, 1958 and later on the name was again changed to National and Grindlays Bank Ltd., with effect from 1st January, 1959.3. ORDERR.N. Dutt, J. 1. This revisional application is directed against an order of conviction and sentence under Section 323 of the Indian Penal Code. 2. The complainant's case was as follows: He was a student of Class VII of Samshi Secondary School in the district of Malda. The petitioner was the Head Master of the School. On August 12, 1961, during school hours one other student named Hiran lost one of his books while in the School. The complainant was found to have stolen that book. The petitioner thereupon treat him with a cane and also gave him fists and blow. 3. The petitioner was on this allegation tried tinder Section 323 of the Indian Penal Code. He pleaded not guilty. The learned Magistrate convicted the petitioner under Section 323 of the Indian Penal Code and sentenced him to pay a fine of Rs. 15/- in default to suffer simple imprisonment for three days. 4. Banerjee, J.1. On December 21st, 1957, the two appellants-petitioners filed a suit, being Title Suit No. 279 of 1957, in the court of the Subordinate Judge at Berhampore, as paupers. They won in the suit. The defendants-respondents appealed against the decree of the trial court before the court of the Additional District Judge at Berhampore. The lower Appellate Court decreed the appeal and reversed the decree of the trial court. The appellate decree bears the date December 13, 1963.2. On February 24, 1964 the petitioners filed memorandum of second appeal in the office of this court, against the Appellate decree, and by a separate application prayed for leave to appeal as paupers.
