This is a Revision Petition directed against the order of an Additional Sessions Judge, Burdwan, upholding the convictions and sentences of the petitioners under Section 7 read with Section 16(1)(a)(i) of the Prevention of Food Adulteration Act, 1954,2. The prosecution case is that the Food Inspector of the Municipality of Asansol went to the shop of the petitioners on the 12th April, 1957, at about 9'O clock in the morning accompanied by a Sub-Inspector of Police. The Food Inspector purchased 6 chhataks of musturd oil from the petitioners, who were in the shop at that time looking after their business, and paid The price thereof. There was another person in the shop who was called as a witness by the Food Inspector to be present at the time when the sample of musturd oil was purchased. Bachawat, J.1. This is an appeal by the Union of India from an order refusing to set aside an award. The disputes arise out of two contracts being A. T. 1000 dated November 30, 1944 and A. T. 1048 dated June 25, 1945 between the Government of India and the respondents Messrs. Bungo Steel Furniture (Pr.) Ltd. Both contracts contain the usual arbitration clause embodied in Clause 21 of the genera) conditions of contract in Form No. W.S.B. 133 for reference of any question or dispute arising in connection with the contract or arising under the conditions thereof. The claims and the counter claims of the parties under the two contracts were referred to the arbitration of the umpire Sir Rupen Mitter. The award of the learned umpire is dated September 2, 1959. The petitioners obtained this Rule on the 27th July, 1960 and also obtained an interim order for injunction in this Rule on the 24th August, 1960.2. The material facts are as follows. The petitioners arc the permit-holders of buses of Jay Kay Nagar route and ply their buses between the dossing of the Grand Trunk Road, Hutton Road, Asansol and Jay Kay Nagar.
