S.P. Mitra, J. 1. This is an application for an order that the sale of a truck by the Company, now in liquidation, to the applicant be declared valid and binding on the Official Liquidator. Briefly, the facts are that on the 10th September, 1958 there was a resolution of the Board of Directors of the Company authorising the sale of some of its assets. Then on September 15, 1958, a creditor's petition for winding up of the Company was presented. The applicant on the 3rd October, 1958 purchased from the Company, Motor Truck No. WBL 1614 for the sum of Rs. 11,000/- and obtained possession thereof. On the same date the Company wrote a letter to the Director of Public Vehicles Department, Calcutta, informing him of the sale. On the 21st October, 1958 the applicant applied to this department for registration of his name as the owner of the truck. This is an application for an order inter alia, that the Share Register or Register of Members of the respondent Company be rectified by inserting the name of the petitioner as the holder of 11,825 fully paid up ordinary shares and 591 fully paid up 7% cumulative preference shares in the place and stead of Mohamed Bashir, deceased. The petitioner's case is that Mohamad Bashir died intestate on the 11th March, 1960 leaving as his heirs and next of kins the petitioner who is his widow, his son Mohamad Riaz and several married and unmarried daughters. On the 16th December, 1960 the petitioner applied to this court for the grant of Letters of Administration of the property and credits including the aforesaid shares of Mohammad Bashir to the petitioner. This is an application for a Certificate under Article 135 of the Constitution in respect of a decision of a Division Bench of this Court, dated May 4, 1961, whereby an application under Section 66 (2)of the Indian Income-tax Act for calling upon the Income-tax Appellate Tribunal to state a case and refer certain questions of law to this Court wassummarily rejected. 2. The petitioner is a Hindu undivided family of which one B.K. Rohatgi is the Karta. In respect of the assessment year 1944-45 the Income-tax Officer included a sum of Rs. 98,426/- as the income of the said joint family. B.N. Banerjee, J.1. The petitioner company, manufacturers of jute fabrics, have their mills at Naihati, in the district of Twenty-four Parganas.2. Respondents 2 to 76 are workmen employed in the factory of the petitioner. They are weavers and their duty is to weave jute goods of different specifications and of varying length and width, on different kinds of looms.3. Sometime in the year 1937, the petitioner company installed in their mills broader looms, namely, 90 inches and 100 inches reed space looms, so as to be able to manufacture wide pieces of hessian of continuous length, according to market demand.4. Respondents 2 to 76 used to be ordinarily employed in the broader looms and used to be paid at piece-rates, their earnings varying with the quantity of fabric woven.5.
