ORDERG.K. Mitter, J. 1. This is an application on the part of Messrs. Lloyds Triestino Societa Per Azinni di Navigazione Sede in Triesta, defendant No. 1 herein for stay of a suit. 2. The suit was filed on June 8, 1957 by Messrs. Lakshminarayan Ramniwas, a firm carrying on business at 18, Netaji Subhas Road, Calcutta, against the said Steamship Co., described in the cause title of the plaint as carrying on business through their agents Messrs. Turner Morrison and Company (Private) Ltd., and the Commissioners for the Port of Calcutta. The plaintiff claims to be an endorsee of several bills of lading issued by the defendant No. 1 in March, 1956 for certain consignments of Mild steel round bars to be transported from Genoa (Italy) to Calcutta. The said consignments reached Calcutta in 'S.S. Alga' on May 22, 1956 and it is alleged in the plaint that on delivery of the goods being taken through the plaintiff's clearing agents in June, 1956 it was found that 22 bundles of rods were short lan...

P. Chakravartti, C.J. 1. The appellant, Prafulla Mohan Mukherjee, was appointed as Assistant Sub-Inspector of Police by the Deputy Inspector-General on 15-1-1925. On 2-1-1942, he was promoted to the rank of a Sub-Inspector and was placed on probation for one year. On 2-1-1943, he was confirmed in the rank of Sub-Inspector. Thereafter, on 10-11-1944, he was posted as a Sub-Inspector, Intelligence Branch, at 13, Lord Sinha Road and continued to serve in that capacity till the partition of India. After the Partition, the appellant opted for the State of West Bengal and having; done so, continued to serve in his old post till the proceedings out of which this appeal has arisen commenced.2. ORDERSinha, J. 1. The facts in this case are shortly as follows.The petitioner joined the Bengal Nagpur Railway, sometime in 1945 in a Class III post, as Traffic Office Assistant (Office Superintendent) Road Transport Branch, Commercial Traffic Manager's Office. He was confirmed in that post in January 1947. In 1950 he was first of all selected by the Selection Board to fill the post of Assistant Road Transport Officer, and he was selected for' a second time for filling a post in Class II in the Commercial Department. What the Selection Board does is to put the approved candidates in a panel, from which officiating appointments are made, strictly according to priority. An officiating appointment may lead to the person holding the post being confirmed therein. The petitioner was first of all appointed to the post of an Assistant Road Transport Officer, which was a post sanctioned only for six months. This appeal arises out of a proceeding which was originally for the grant of probate of the Will of one Giribala Dasi, later on converted into one for grant of Letters of Administration in respect of the said Will on the death of the original executor applicant. The Letters of Administration have been granted by the court below. But to the grant has been annexed a compromise or agreement, to which the appellant, who was the plaintiff in the court below, objects. 2. The will in question was said to have been executed by one Giribala Dasi. Under the Will, the present appellant was the sole legatee in respect of Giribala's properties which have been enumerated in the schedule of the application for the grant. ORDERSinha, J.1. The petitioner before me is Messrs. Calcutta Chemical Company Ltd, which as its name signifies, is a public limited company carrying on business as manufacturer of chemical and pharmaceutical products. It is stated in the petition that for over 30 years the petitioner has been using Wood-Naptha as a chemical solvent in connection with the petitioner's business of manufacture of chemicals and pharmaceutical products. On the 25-5-1951 the petitioner was granted by the Import Trade Controller, a license for the purpose of importing divers chemicals including Wood-Naptha. In fact, the said license is in renewal of an earlier license dated 7-12-1950. It appears that sometime in January 1951 an order was placedwith Messrs. Bayer and Company of Germany, a famous manufacturer of chemicals, for a quantity of Wood-Naptha.
