On 10th June, in the early hours of the morning, two girls Jaba aged 16 or 17, and Charu aged 18 or 19, the sister and cousin respectively of the complainant Mihi Lal, and under his care on behalf of their husbands, are alleged to have been abducted by the accused. Sova is a sister of Bepin, and mistress of one Nogen. Akshay is a fellow-worker of Nogen. Bepin was priest in the house-holds of both girls' parents and officiated at their marriages. Sova induced the girls to leave home on the pretext of taking them on a pilgrimage bo the Ganges. Later they were joined by Bepin, Akshay and another. Eventually they reached Calcutta, and from there Akshay took them by train to Khardah, and lodged them with a prostitute named Suro Bala. Then Akshay went away for three or four days, and returned with Bepin, and each girl was ravished by one of the two accused and deprived of their ornaments. Mallik, J.1. These two cases were heard together. One is an appeal and the other is a revision case. In the appeal case, two men, Section Rule Varma and Major Cunington, former the proprietor and latter the manager of a Carnival known as the Happy World, have been convicted under Section 44, Calcutta Police Act, and sentenced-Varma to a fine of Rs. 250 and Cunington to a fine of Rs. 75 by a Presidency Magistrate. In the revision case, two men Section M. Sen and Captain Tatum, the former the proprietor and the latter the manager of another Carnival known as the Victoria Carnival have been convicted by the same Magistrate under the same section and sentenced Section M. Sen to a fine of Rs. 75 and Tatum to a fine of Rs. 40. The two cases, it would appear, were with the consent of parties in a way heard together and the judgment was given to cover both the cases. Hitter, J.1. The appellants are decree-holders. They have appealed against an order dismissing their application for execution on the ground that Annada who is one of the persons seeking execution of the decree is neither one of the original decree-holders nor an assignee of any of the original decree-holders and on the further ground that their previous application for execution having been dismissed for default and the application having been treated as an application in the original suit the claim of the plaintiff for recovery of mesne profits from the defendants cannot be sustained. In other words it has been held that the effect of the dismissal of the previous application for execution on the ground of default amounted to a dismissal of the claim for mesne profits. Patterson, J.1. The lands that form the subject matter of the suits out of which these appeals arise, are situated in Mauza Jagtala which at one time constituted or formed a part of a Patni Taluk. As a result of a partition by the civil Court, this Patni Taluk was split up into a number of Sahams, and possession was delivered in accordance with the partition thus effected in or about the year 1894. During the pendency of the partition proceedings in the civil Court, one of the co-sharer patnidars, namely Ishan Chandra Sarkar, granted a darpatni lease of his undivided 2 gandas share in the Patni to one Dina Bandhu Bhaduri, and it appears that some of the other cosharer patnidars also granted darpatni lease of their respective shares at or about the same time.
