SHRI. M.K. ABDULLA SONA : MEMBER This appeal prefers from the order passed by the CDRF, Ernakulam in OP 407/2004. The appellant is the 1st opposite party and the respondents are the complainant and 2nd opposite party in the above mentioned OP. This appeal prefers under the order directed the opposite parties to pay the complainant Rs. 34,000/- with interest at 10% per annum from the date of filing of the complaint on 12.8.04 and cost of Rs.1,000/- within a period of 1 month from the date of receipt of a copy of the order. Both parties are jointly and severally liable to comply with this order. 2. In brief, the complainant have a case that he purchased a Maruthi Sen LX vehicle on 19.2.03 manufactured by the 1st opposite party, from the 2nd opposite party for plying it as a taxi for earning his livelihood. JUSTICE SHRI. K.R. UDAYABHANU: PRESIDENT Appellants are the opposite parties 2 and 3 in CC.123/11 in the file of CDRF, Kasaragod. The matter stands disposed of uncontested. The opposite parties/appellants were exparte before the Forum. It is submitted that the counsel failed to appear before the Forum on the posting date. In the circumstances and in view of the fact that the order is not a properly considered one the same is set aside on condition that the appellants/opposite parties pay a sum of Rs.8000/- towards cost or deposit the same before the Forum which can be withdrawn by the complainant. According to the complainant he travels mainly in motorcycle and car and hence the footwear was not used in a rough manner.
