UDAYABHANU: PRESIDENT The appellants are the opposite parties in OP.425/01 in the file of CDRF, Thiruvananthpauram and under orders to pay a sum of Rs.49500/- with future interest are 14.5% and also to pay Rs.20000/- as compensation and Rs.2000/- towards costs. 2. The case of the complainant is that she purchased a computer for a sum of Rs.49500/- from the opposite parties and that from the very next day itself the computer was found to be defective. It is mentioned that the computer was repaired several times by the opposite parties. But still the computer was not working. The computer was purchased for the use of the younger brother of the complainant who is undergoing degree course in Electronics and Telecommunication; and she had purchased the computer after availing a bank loan. The challenge in these writ petitions essentially relate to the list prepared by the Public Service Commission for the post of Sub Engineer (Electrical) in the Kerala State Electricity Board pursuant to its notification dated 2.12.2003. Though the grounds of challenge are not identical, since the list published by the PSC, forming subject matter of the challenge in these writ petitions is common, they have been heard and are being disposed of by this common judgment. It is necessary to refer to the bare facts involved in both these writ petitions separately. I will refer to the facts in writ petition No. 12199/2006 in the first instance.2. The PSC invited applications for the post of Sub Engineer (Electrical) in the KSEB as per Ext.P1 notification dated 2.12.2003. The petitioner applied and was asked to participate in the written test. The scope of Rule 56B(i)(a) of Part I of the KSR vis-a- vis the operation of the Kerala Civil Services (Classification, Control and Appeal) Rules 1960 {for short 'the Rules'} comes up for consideration in this case. While this Court has, on several occasions, spoken on the nature of the power to be exercised under Rules 56 and 56B of Part I of the Kerala Service Rules {for short 'KSR'} dealing with the question as to the pay and allowances that a Government servant is entitled to, on reinstatement after revocation of a suspension, in relation to the period during which he was kept under suspension, the question as to whether Rule 18(b) of the Rules has overriding effect in these matters does not seem to have been specifically raised for consideration in such cases.
