Sreedharan, J.1. These Original Petitions are by a sister and brother. It was alleged that they secured admission to the M.B.B.S. Degree Course by producing fake mark lists showing inflated marks in the qualifying examinations. The Syndicate of the University of Kerala enquired into the matter, found them guilty of manipulating the mark lists and consequently cancelled the examinations taken by them. They challenge the said action of the Syndicate.2. A Division Bench of this court while disposing of a batch of Original Petitions by judgment dated 23-12-1981 detected various irregularities in the conduct of examinations, preparation of mark lists and in the admission of students to various professional courses. This appeal arises out of an original petition filed in this Court by the respondent herein under Section 18 of the Divorce Act praying that his marriage with the appellant may be declared null and void under Section 19 of the Act, on the ground that the appellant was a lunatic or idiot at the time of marriage and that she was unable to give any valid consent for the marriage. It was also averred that the respondent's consentfor the marriage had been fraudulently obtained. He also alleged that the appellant was impotent. On the basis of these averments the respondent prayed for a declaration of nullity of the marriage. 2. The respondent belongs to Murthomite Christian community and the appellant-wife is a Jacobite Christian. The marriage between the appellant and the respondent was solemnised on 29-8-1974 at the St. Thomas Mar Thoma Church at Niranam. Sreedharan, J. 1. O.P. No. 3220 of 1983 and Writ Appeal No. 127 of 1984 are by the same person. When he approached the University for registration to the B.Sc. (Engineering) Semester Examinations (III to VII Semesters) of April/May 1982 and Oct./Nov. 1982. the University rejected the same by Exts. P9 and P10 memos dt. 19-10-82. O.P. 3220 of 1983 was filed for quashing those memos and for a writ of mandamus directing the University to forbear from giving effect to the order, debarring him from appearing in examinations. Subsequently, the University enquired into the acts and conduct of the petitioner. A member of the Syndicate who enquired into the matter filed a report to the Syndicate, finding the petitioner guilty of using false and forged Pre-Degree Mark List for getting admission in the Engineering College. The first petitioner is a Private Limited Company carrying on business of manufacturing and marketing Pharmaceuticals. The second petitioner is a citizen of India having substantive interest in the first petitioner. The third petitioner is the Manager of field operations of the regional office of the Company.2.
