V.P. Gopalan Nambiyar, Actg. C.J.1. These are two connected appeals from the common judgment of a learned Judge in two writ petitions, O.P. Nos. 4328 and 4628 of 1972. The writ petitions were by two different labour unions to quash the award of the Industrial Tribunal, Calicut. The learned Judge quashed the award and directed the Tribunal to go into the question afresh and dispose of the matter in accordance with law and in the light of the observations contained in his judgment. The Management, viz the Co operative Tea Society Ltd. literati, has preferred these appeals.2. The appellant is the owner of the four tea estates in North Wynad with which we are concerned in these writ petitions, and one, known as the Rippon Tea Estate, in Sooth Wynad. The two unions who filed the two writ petitions which have given rise to these appeals had been functioning for a long time in the estates involved in these appeals, but not in the Rippon Estate.
