This case has been placed before a Division Bench on account of the difference of opinion among some of the learned Judges of this Court regarding the scope and applicability of Sub-section (3) of Section 125 of the Kerala Land Reforms Act, 1963 (hereinafter referred to as the Act).2. The petitioner is the fifth defendant in a suit, O. S. No. 117 of 1970. which the fifth respondent filed in the Subordinate Judge's Court, Palghat for recovery of possession of a few items of immovable property on the basis of title. Defendants 2 to 5 pleaded that they were tenants of Items 2 to 5 and 13, and that they were not, therefore, liable for ejectment. They produced a few documentsin support of their plea. ORDERP. Subramonian Poti, J. 1. The Kerala Co-operative Tribunal, Trivandum, in the order Ext. P3 which is under challenge here, held that there is no question of applying the provisions of the Limitation Act, 1963 in the matter of adjudication of a claim under Section 60 of the Travoncore-Cochin Co-operative Societies Act 1952 materially corresponding to Section 69 of the Kerala Co-operative Societies Act. The only ground of attack as against Ext. P3 order is that the Tribunal was in error in holding that the Limitation Act would not apply in the matter of adjudication of the claim under the provisions of Section 60 of the Travan-core-Cochin Co-operative Societies Act or Section 69 of the Kerala Co-operative Societies Act,2. The petitioner is the president of the Kerala State Committee of the Centre of Indian Trade Unions (CITU) and the president of the Azhicode Power-loom Mills Workers Union, Azhicode. The question raised in this petition concerns the conduct of the police in regard to satyagraha and other forms of agitation resorted to by the workmen of Ravikrishna Mills and Usha Textiles, both at Azhicode, to press, what according to them are, their legitimate demands. The petitioner complains of certain mass retrenchments of workmen which, according to him, was mala fide and unjustified. It is said that the District Labour Officer called conciliation conference on 13th February, 1974, but the management refused to attend it.
