ORDERC.A. Vaidilaingam, J.1. The common question that arises for consideration in these 43 writ petitions tiled by the various petitioners, is as to whether the sales of tea, in respect of which Sales Tax has been levied or sought to be levied, for the various years in question under the provisions of the General Sales Tax Act, 1125 -- (Act 11/1125) are sales in the course of export of the goods out of the territory of India and as such exempt from State taxation under Sub-clause (b) of Clause (1) of Article 286 of the Constitution.2. According to the petitioners, the sales in question are so exempt and therefore, no bales Tax can be levied by the State whereas according to the Revenue, those sales do not come under Article 286(1)(b) and the State is entitled to levy and collect Sales Tax.3. Anna Chandy, J.1. The Revision Petitioner Shri A.K. Gopalan was convicted Of the offence of defamation under Section 500 of the Indian Penal Code and sentenced to pay a fine of Rs. 500/- by the Sub-Divisional Magistrate, Alleppy, His appeal to the Sessions Judge was dismissed and he has now moved this Court in revision.2. The charge against him was that be defamed Shri V. Mariarputham, Officiating Superintendent of Police in a speech made by him at the Kidangamparambu Maidan, Allepy en 23.10.1958 on the 'Vayalar-Punnappra Marty's' Day. The accused is alleged to have dwelt upon the police firing at Munnar and stated that Shri Mariarputham accepted bribes from tile estate owners to please whom he ordered firing. The offending speech was published in a leading Malayalam daily paper The Kerala Kaumudi. The portion of the report containing the alleged defamatory imputations is marked as Ext. Kuriakose, learned Counsel for the writ petitioner, attacks the order of the authority appointed under the Minimum Wages Act in M.W.C. 1 of 1959, dated 31 October 1960.2. The respondent filed an application on 26 March 1959 claiming overtime wages for the period from 1 October 1958 to 29 January 1959.3. The claim of the worker was resisted by the petitioner-employer on several grounds, namely, on fact and also on law. The legal contention that was raised was to the effect that the workman has been dismissed from service by the employer on 31 January 1959 and inasmuch as the application before the Minimum Wages Authority was filed only on 26 March 1959, the application is not maintainable as he has ceased to be an employee of the petitioner.
