The appellant Kunhootty has been convicted under Sections 302 and 324 of the Indian Penal Code and sentenced to suffer life imprisonment with a concurrent sentence of six months rigorous imprisonment by the Sessions Judge of Telhcherry for causing the death of one Joseph and causing hurt to P.W. 1, John by a dagger at about 7 P.M. on 15-4-1958.2. The prosecution case may be stated as follows ;The deceased Joseph aged 27 and the accused Kunhootty aged 26 belonged to two Christian families, which migrated from Travancore and settled in North Wynaad. their houses being one mile apart. On 15-4-1958 at about 7 P.M.. P.W. 1 and his elder brother the deceased Joseph were herding their caltle home when they met the accused on his return from his day's work, near the Neeli tree marked X in the plan Ex. P-19. On 9-2-1959, the Second Member of the Board of Revenue (who is the 3rd respondent in each of these cases, the 1st being the State of Kerala, the 2nd the Board of Revenue, and the 4th. a private party) sold by public auction the right of vending arrack in the eight arrack shops, and: toddy in the 31 toddy shops, of the Thodupuzha Taluk for the year ending 31-3-1960. This was in pursuance of two notifications (one for the arrack shops marked as Ext. PI in O.P. 269, and the other for the toddy shops marked as Ext. P1 in O.P. 270) issued by the State Government and published in the Gazette of 23-1-1959 and in two subsequent issues. Motors and Timbers (Private) Ltd., a motor transport company, for the issue of a writ of certiorari, quashing the Order Ext. B, dated 31-1-1959, passed by the first respondent, who is the Secretary, Regional Transport Authority, Trivandrum, granting a temporary stage carriage permit to the second respondent, the Director of State Transport, Kerala State, for the route Trivandrum (Cantonment)-Neyyattinkara via Kattakada. This route, among others was served by the petitioner, for about six or seven years in the past by providing motor transport under a stage carriage permit held by it. His complaint is that he has been wrongly suspended as and from 4-12-1958 from his office as Principal by the respondent, the Cochin Deva-swom Board, in whom is vested the management of the College. .2. The petitioner joined this institution in 1957 within a week of its inauguration as a First Grade College as Professor and Head of Department of History and Economics.
