ORDERVithayathil, J.1. Second accused in P. E. No. 4 of 1125 on the file of the Moovattupuzha Stationary First Class Magistrate's Court is the Revision. Petitioner. The preliminary enquiry is based on a private complaint. The complainant's case is that he and the first accused were running a partnership business, that the partnership was terminated on 15-5-1124, that the complainant took the textile articles of the business while the first accused retained the lemon grass oil on the agreement that he would sell it with the knowledge of the complainant and give him one half share of the profits, that contrary to the agreement the first accused sold a portion of the lemon grass oil with the connivance and help of the second accused towards the end of Thulam 1125 and misappropriated the sale proceeds, that when the complainant questioned the first accused about the matter the latter agreed to pay the complainant's share of the profits on 15-4-1125 and directed the complainant to go to the...

This is a petition under Article 226 of the Constitution of India for Issuing a writ of certiorari or other appropriate directions quashing the order of the Travancore-Cochin Government 12-12974/52/DD, dated 20 November 1952, published in the Travancore-Cochin Government Gazette, dated 25 November 1952, referring an industrial dispute for adjudication to the industrial tribunal, Quilon.2. The petitioner is Sri Sankara Allom, Ltd., represented by its managing director Sri T.V. Krishna Iyer. The Cape Comorin General Traffic Company, Ltd., which is now in liquidation, owns salt factory, known as Company Allom or extension factory No, 2, at Thamarakulam. When the liquidation court auctioned the right to manufacture salt in this factory for the Malayalam year 1128 the petitioner, Sri Sankara Allom, Ltd., bid the same. ORDERGovinda Pillai, J.1. The Special First Class Magistrate, Trichur, started proceedings in M. C, 6 of 1952 against one Ouseph alias Kunhani under Section 110(a), Criminal P. C. and passed orders directing him to execute a bond for Rs. 500/- with two sureties each for a like amount for good behaviour for a period of two years. On his failure to execute the bond, the Magistrate detained him in custody and referred the matter to the Sessions Judge, Trichur, under Section 123(3), Indian Criminal P. C. The learned Judge accepted the reference and committed him to prison to undergo rigorous imprisonment for a period of two years from the date of his order which was on 3-6-1952. The Magistrate had by his warrant dated 31-3-1952 detained Ouseph in custody.2.
