The appellant was the plaintiff before the trial court in a suit for partition and separate possession and the plaintiff had sought for 4/5TH share in the suit property, which was some in favour of defendant No.1, who had in turn constructed a house therein. The sale deed was of some antiquity. The suit so filed in respect of the said property had inexplicably excluded the other properties belonging to the family. At the trial, it was established that there was no challenge to the construction put up by the defendant No.1. It was also not disclosed as to why the plaintiff did not include the other properties, which were available to the family and it was also not established that the suit property was the joint family property by providing any material evidence.
