1 .This appeal is by the complainant assailing the older of acquittal of the respondent - accused paused by the PRL. Civil Judge and JMFC, Chickmagalur in CO No.5548/2002 dated 17.09,2008.2. According to the complainant, the accused along with others and himself, are the partners of the firm called M/s. Green Agencies. It appears, the said firm which was constituted in the year 1988 by four partners investing Rs.25,000/- each, was dissolved and re-constituted on 10.08.2001 and in that regard, a settlement was arrived at between the partners and towards the final settlement between the partners, the accused issued a cheque for Rs.9:50,000/ - drawn on Bank of India, to the retiring partner - complainant as his share of settlement. On presentation of the cheque for encashment, the same was dishonored with an endorsement 'payment stopped by drawer'.
