The petitioner, questioning the legality and validity of the charge-sheet dated 24.1.2006 issued by the respondent in No. PAD:DISC:340:04:2508:2005-06, vide Annexure-F and all further proceedings, in pursuance of the same as unsustainable, has presented this writ petition2. It is not in dispute that, petitioner was appointed as guardian in respect of minor children Manjula and Vijayakumar, who are the children of his sister. On account of love affair developed while studying 6th standard by Manjula the same was ended in marriage with one Sri. Kotreshi. It is the further case of the petitioner that, he has availed loan on the deposit of Smt. Manjula. Smt. Manjula on attaining the age of majority has complained with the Chairman of the respondent-Bank that, petitioner has misappropriated the amount in deposit. No. 4/1A, on account of acquisition for formation of residential sites by the Belgaum Urban Development Authority, was allotted site No. 1467 under Scheme No. 35. It is the claim of the petitioner that the said plots measuring o-7-7 were purchased from his vendor Sri Ganapath G. Valvekar under a registered sale deed dated 19.2.1970. The petitioner, a holder of a stage carriage permit No. 37A/59-60 for the route Bheemasamudra to Shimoga and back and Chitradurga to Rayanahalli and back was issued with a fresh Permit No. 53/98-99. On the expiry of the period of permit, the petitioner's application for renewal was allowed, by resolution dated 5.7.2004 of the RTA, Chitradurga. Aggrieved by the renewal, the 2nd respondent KSRTC filed Rev. Petition 612/2004 before the Karnataka State Transport Appellate Tribunal, for short KSTAT, contending that the route in question overlaps the notified routes under the Schemes of Shimoga, Bellary and Bangalore was allowed by order dated 28th July, 2005 Annexure B recording a finding that the RTA, despite the objections of the KSRTC, did not obtain a joint route survey to ascertain as to whether the route for which the renewal of permit was sought for, overlapped the notified route, while strangely recording findings that the route overlaps the notified route...
