In this case the petitioner has sought for an order directing the respondent to return all his belongings said to have been taken away by the respondent on 20.3.1999 from his house at Bangalore. He has sought for a further direction directing the respondent to deliver the said belongings to his present address or to his permanent address with an advance intimation to him to that effect.2. The brief facts of the case are as under;The petitioner had joined the respondent-Company in March 1980 as the Head of Personnel and Administration of Bangalore Complex. The respondent had transferred the petitioner from Bangalore to some other place. The transfer order was challenged by the petitioner by filing a writ petition before this Court. Aggrieved by the order of the learned single Judge dated 20.08.2003 whereunder following the decision in W.P.Nos. 27096-107/2003 dated 18.07.2003 directing the appellants herein to pay interest on the compensation awarded from the date of award till the date of payment of said amount, the present writ appeal is filed by the Government. There is no much dispute so far as the facts are concerned. The petitioners whose lands were acquired and submerged in the Almatti project had approached this Court in the said writ petition seeking entitlement for award of interest from the date of taking over possession of the residential building which was not paid to them.2. ORDERK.L. Manjunath, J.1. According to the petitioner, he is the owner of 40 acres of land in Sy. No. 7/A of Aiyangeri village, Kodagu Dist. For non-payment of assessment amounting to Rs. 8839-60, 6 acres of land has been sold by the revenue authorities for a sum of Rs. 9256/-. Sale was held on 14.8.1990. R-4 did not deposit any amount on the date of sale and thereafter he deposited the amount on 4.9.1990. Sale was confirmed in favour of R-4. Aggrieved by the same, petitioner filed an appeal before the Deputy Commissioner, Kodagu, contending that a fraud has been played in selling the property of the petitioner even though it was a coffee plantation, it has been sold for a poultry sum of Rs. 9256/- and that R-4 did not deposit 25% of the amount on the date of the sale and the remaining 75% within 15 days as required under the law. These two appeals by the United India Insurance Company are directed against the award of the M.A.C.T., Bagalakote, allowing the claim applications filed by one Akkavva (claimant in M.V.C. No. 34/2002) and one Neelawwa (claimant in M.V.C. No. 811/2001) and as the accident in question is one and the same, these two appeals are disposed of by this common judgment.2. The case of the respective claimants is that on 21.8.2001, when they, along with several others, were travelling in the tractor-cum-trailer No. KA-28/T-1170 & 1171 on Bagalakote-Alamatti Road, the vehicle, being driven in a rash and negligent manner by the driver concerned, turned turtle leading to the above named claimants suffering injuries along with many others, who were also in the said vehicle.
