The respondent herein filed a complaint under Section 200 of the Criminal Procedure Code against the petitioner alleging that two cheques issued by the petitioner were presented to the Bank on 9-5-2000 and received Bank endorsement on 11-5-2000 informing that Account was closed and the cheques were dishonoured. Therefore, he got issued a notice on 12-5-2000 to the petitioner which was refused by the petitioner on 15-5-2000. Thereafter, the respondent filed a complaint on 24-6-2000. The accused at the relevant time was working as Village Accountant of Veeradevanapura Group Panchayat in Nanjangud Taluk and it is alleged that on 28-3-1985 he demanded and accepted illegal gratification of Rs. 450/- in consideration for change of khata. This was a case in which the accused is alleged to have demanded Rs.500/- for doing the job from P.W. 2-Sundaramma. According to the complainant, she was doing coolie work and she told the accused that she is so poor that it is impossible for her to produce that amount of money and the accused flatly refused to relent. Thereafter, her brother is supposed to have met the accused again and paid him Rs. 50/- with a promise that he would bring the remaining amount on 28-3-1985. 1. This intra-Court appeal arises out of the order passed in Writ Petition No. 5550 of 1993. The appellants are the writ petitioners who challenged the orders of the Land Tribunal, Gokak in respect of grant of occupancy rights relating to Block No. 183, measuring 12 acres 21 guntas of Sindikurbeta Village. In the earlier proceedings in Writ Appeal No. 1927 of 1983, it is submitted that the parties in the proceedings had compromised the matter and affidavits are also filed. The writ appeal came to be withdrawn with an understanding that the parties shall before the Land Tribunal enter into a compromise in the terms agreed between them at the stage of writ appeal. M.F. Saldanha, J. 1. We have heard the learned Additional State Public Prosecutor and the learned Counsel Sri Shivappa who represents the respondents-accused on merits. The allegation against the accused was that Al being the husband and A2 and A3 being the mother and senior uncle of A1 that they had received a sum of Rs. 5,000/- at the time of the marriage of deceased, Mahadevi. On 1-6-1991, Mahadevi suffered serious burn injuries, she was taken to the K.R. Hospital, Mysore on 2-6-1991 and she died on 15-6-1991. On 3-6-1991 the police Head Constable is alleged to have recorded a dying declaration in which he has implicated the accused but that document suffers from a host of legal infirmities as a result of which the Trial Court itself rejected the same.
