ORDERR. Gururajan, J.1. Petitioner is seeking the following prayers in this petition:'(i) Issue a writ, order or direction in the nature of certiorari quashing the endorsement dated 10-9-2001. in No. B5/SMG/1347/2001-02 (Annexure-A) issued by the 2nd respondent; (ii) Issue a writ, order or direction in tbo nature of mandamus directing the respondents 1 and 2 to consider the case of the petitioner for appointment on compassionate ground and appoint him in any suitable post in the service of the respondent 1; (iii) Grant any other reliefs as this Hon'ble Court may deem fit in the facts and circumstances of the case in the interest of justice'.2. M.F. Saldanha, J.1. The State of Karnataka has assailed the acquittal of the respondent-accused in Sessions Case No. 25 of 1990 disposed of by the learned Sessions Judge, Tumkur on 28-7-1995. The prosecution alleges that the husband Puttarangappa had suspected the fidelity of his wife Smt. Ran-gamma and that on the morning of 7-12-1989 at about 6.30 a.m. in front of the house occupied by them in the village he had brutally assaulted the deceased wife with a Machu. The condition of the body clearly indicates that the assault was a savage one with the majority of blows aimed at the face and neck of the deceased as a result of which she died on the spot. The prosecution case is that P.Ws. 1 and 2 who arrived on the scene very shortly after the incident found the accused with the Machu in his hands, that they had snatched it from him and after disarming him that he was tied up and kept there until the arrival of the police. This civil revision petition is directed against the order dated 18-12-1999 passed in Civil Miscellaneous Case No. 3 of 1998 on the file of the Court of the Civil Judge (Junior Division), Siruguppa dismissing the said civil miscellaneous case.2. V. Gopala Gowda, J. 1. The appellant was the plaintiff in the Trial Court. He filed the suit in Original Suit No. 322 of 1975 for declaration of title and permanent injunction in respect of the suit schedule properties. The case of the plaintiff was that four items of properties were gifted to him under a registered gift deed dated 25-3-1971. The defendant admitted execution of the gift deed in favour of the plaintiff but resisted the suit on the ground that only two items of properties had been gifted and not four items. On the basis of the pleadings, the Trial Court framed issues. Both the parties led evidence by examining witnesses and producing documents. On appreciation of the material on record, the Trial Court decreed the suit partly holding that plaintiff is the owner of suit schedule items 1 and 2 and in respect of suit schedule items 3 and 4 dismissed the suit by its judgment dated 30-10-1980.
