ORDER1. This revision petition under Section 115 of the Code of Civil Procedure, for short, 'CPC' arises from the judgment and order dated 23rd December, 1995, passed by (Sri A. Mohan Ram), 14th Additional City Civil Judge, Bangalore, dismissing or rejecting the defendant 4's application under Section 151 of the CPC moved in original suit number O.S.4223 of 1995, whereby the 4th defendant sought permission to complete the construction of the building in suit and to occupy the same.2. The facts of the case in the nutshell are that the plaintiff- respondent filed the suit for declaration of title as well as for perpetual injunction in respect of an area of 3 acres 6 guntas of land of Sy. No. 6/2, Kempapura Village, Yelahanka Hobli. He also sought decree for recovery of possession. ORDER1. The petitioners in these petitions are all working as Assistant Accounts Officers in the respondent-Corporation. From the inception the posts of Assistant Accounts Officers/Geologists/and Engineers carried the same pay scale. Thereafter, the respondent has amended the regulations governing the service conditions of the employees of the Corporation thereby the post of engineers is placed on a higher pay scale than the petitioners from 10-6-1988. This amendment was challenged by the petitioners and others in W.P. Nos. 7781 to 7918 of 1988 before this Court. This Court dismissed the writ petitions upholding the validity of the amendment. However, this Court has directed the Corporation to constitute an Expert Committee for the purpose of providing equal pay for equal work assessing the comparable worth of engineering and non-engineering posts.2. ORDERG.C. Bharuka, J. 1. With the consent of the parties these writ petitions and the appeals have been heard together for final disposal. For the sake of convenience we will be referring to the parties as per their ranks arrayed in the proceedings before the Court below. 2. The petitioner/appellant is the sole defendant in Arbitration Case Nos. 3 and 4 of 1996 purported to have been filed before the Prl. District Judge, Mysore, under Section 8 of the Arbitration and Conciliation Act, 1996 ('1996 Act' for short). In the said cases the plaintiff-respondent had sought for appointment of an arbitrator in terms of the Arbitration Clause and referring of the dispute to the said arbitrator. 3.
