The brief facts of the case are that the respondent herein challenged the order passed under Section 7-A of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (hereinafter for short. called the 'Act'). Originally, The Annapoorna Paper Mills was assessed under the Act. The said mill was closed on 28-9-1984. Subsequently, it defaulted the payment of loan which it had borrowed from the Karnataka State Financial Corporation (KSFC). On 1-10-1985, the KSFC, invoking power under Section 29 of the State Finance Corporation Act, 1981 took possession of the assets of the mills and sold the same. In this petition for a writ of certiorari, the petitioner calls in question the validity of an order issued by the respondent-Medical Council of India and the recommendations of Migration Sub-Committee declining permission to the petitioner to migrate from the Alameen Medical College, Bijapur to the Siddartha Medical College at Tumkur. A mandamus directing the respondents to permit the proposed migration has also been prayed for. The controversy arises in this following circumstances:The petitioner was selected by the CET Cell to undergo a five years MBBS Course in the Alameen Medical College at Bijapur as a merit candidate. ORDER1. It is a peculiar case in which the petitioners have sought refund of stamp duty and registration fee after registering the sale deeds in respect of the property purchased by them.2. The petitioners purchased lands bearing Sy. Nos. 46/B and 4-7/1 of Huliyar Village in Tumkur District. The sale deeds had been got registered after paying the requisite stamp duty and registration fee as prescribed in the Karnataka Stamp Act. Thereafter the petitioners claimed refund of the stamp duty and registration fee on the ground that since they purchased the properties for the construction of cinema theatre, the stamp duty and registration fee are exempted under Government Orders dated 3-6-1994 and Official Memorandum dated 10-12-1997. The Indian Overseas Bank is the petitioner aggrieved by the order passed on the application filed under Order 9, Rule 13 setting aside thedecree dated August 31, 1989 in 1997 at the instance of the surety, the second defendant on the ground that the surety signature had been forged on all the documents including the court records, suit summons as well as the bank records.3. The learned judge has chosen to accept the version of the surety and set aside the decree in its entirety. It is that order that is' challenged before me in this C. R. P.4. Basically, the order passed by the court below is not sustainable as the court has no jurisdiction to set aside the decree as against the first defendant, the main borrower. M.F. Saldanha, J.1. The State of Karnataka has assailed the acquittal of original accused Nos. 1 to 7 through the present appeal. Original accused No. 1 died on 14-4-1996 and hence, the appeal against him has abated. We are effectively concerned with the remaining accused. The prosecution alleged that accused Nos. 1 to 7 formed an unlawful assembly on the morning of 21-7-1989 near the entrance gate of village Govinakoppa near the Tea Shop in which P.W. 16 Gurupadappa was working and that the accused were armed with axes and clubs and that they assaulted Yankappa, son of Bhimappa Uppar and that his brother Nagappa was also assaulted in the course of the same incident. The injured persons were taken to hospital and Yankappa died at about 9 p.m. on the same night whereas Nagappa survived.
