The two points which arise for consideration in this appeal are -(1) whether the quantum of the permanent alimony awarded by the lower Court to the appellant is inadequate; and (2) whether the lower Court has erred in refusing to direct the respondent to return the property claimed by the appellant.2. ORDER1. Similarity of predicament warranting common relief has compelled the petitioners to invoke the writ jurisdiction under Art. 226 of Constitution. Quashing of the order of the State of Karnataka passed on 25-8-1983 in Order No. CI 17 SPD 83 is sought in these writ petitions by the petitioners who are manufacturers of spun concrete pipes used for the purpose of water supply, sanitation and irrigation.2. The learned Single Judge upheld the order passed by the Appellate Authority as well as the revisional Authority under the Karnataka Municipalities Act, 1964 holding that the building owned by the Vijaya College Trust, wherein respondent No. 1 -Vijaya College was being run for the purpose of imparting education was exempt from payment of property tax being a charitable institution.2. This appeal is directed against the order of the learned Single Judge of this Court, dated 8th January 1987 in Writ Petition No. 5427/1983 whereby he dismissed the Writ Petition filed by the appellant herein and one other (since deceased) seeking quashing of the endorsement Annexure-D by the Sub-Registrar, whereby he refused to register the Trust Deed executed a Trustee of Sri Raghavendra Swamigalu Brindavanam Trust, K.M. Puram, Mysore, for the reason that the Registrar of Societies, Mysore, has by his order dated 31-12-1982 prohibited him from registering the said document. Against a claim of Rs. 32,500/- by the petitioner in the said case before the Accident Claims Tribunal-VIII, Bangalore City, the petitioner therein was awarded a sum of Rs. 1,650/-.2. The appellant's sole defence in the said case was that he was not the owner of the Vehicle and, therefore, he was not liable to pay any damages to any one muchless the claimant-petitioner.
