ORDER1. This is a Revision Petition under section 397 of the Code of Criminal Procedure (the Code for short) and is directed against the order dated 19-3-1990 made by the learned 111 Additional Sessions Judge, Belgaum. in Criminal Revision Petition No. 242/88 on his file. 2. The matter is heard on admission. 3. The facts are these : Sri Abdul Khader, the petitioner, married Smt. Razia Begum, the respondent, on 27-4-1977. In course of time there cropped up differences between the petitioner and the respondent. According to the petitioner, some days after the marriage, the respondent deserted him and went to reside with her parents. According further to him, his efforts to bring her back to his roof through the intervention of elders proved futile. The respondent filed an application under section 125 of the Code, seeking a monthly maintenance allowance in a sum of Rs. 300/- from the petitioner, in Miscellaneous Case No. 50/82. The facts leading to the writ appeal are shortly as follows : Premises known as 'Hotel Shivaprasad,' situated at Kundapur Town belongs to a partnership firm consisting of the following partners : (1) V. K. Shetty (2) B. Arunkumar Shetty (3) Arithkala S. Shetty (4) Vasanthamala S. Shetty and (5) Amrithkala S. Shetty One P. N. Krishna Murthy Bhat was a Lessee of this premises who was running a restaurant. O.S. No. 28/1978 was filed before the Learned Civil Judge, Udipi for his eviction. That ended in a decree in favour of the landlord. In execution of that decree in E.C. No. 14/1983 ultimately, possession was delivered to the landlord on April 22, 1983. The facts leading to the writ appeal are as follows : The Mysore Chemicals and Fertilisers Ltd., (hereinafter referred to as 'the Fertilisers Ltd., ') was a company carrying on the business of manufacture of chemicals and fertilisers at Balgola, Mandya District, Karnataka State. The company had its own land and building where the manufacturing process was carried on with the help of machinery, which machinery also belonged to the company 2. The company was ordered to be wound up by an order of this Court dated 14th of December, 1972. Long prior to this date, the company had stopped its manufacturing operations and discharged all the workmen. The reconstitution of the company failed. Therefore, its assets were sold by public auction held by this Court. The appellant purchased the said assets of the Fertilisers Ltd., consisting of land, building and machinery on 27th of June, 1975 for a sum of Rs. 85,00,000/-. All these writ petitions can be dealt with under a common judgment since they question the validity of section 5B of the Karnataka Sales Tax Act, 1957, introduced by the Amendment Act No. 27 of 1985, with effect from 1st April, 1986. 2. We propose to note the facts in Writ Petitions Nos. 2064 to 2067 of 1988 : The petitioners are civil engineering contractors engaged in civil construction work in the State of Karnataka. In order to bring the activity of works contract within the purview of power to levy sales tax by the respective State, amendments were introduced extending the definition of 'sale' under article 366(29-A) of the Constitution of India. Following the constitutional amendment, the Karnataka Sales Tax Act was amended by the Amendment Act No. 27 of 1985.
