Hiremath, J.1. This appeal is directed against the Judgment and decree of the Court of the Additional Civil Judge, Bijapur, in RA No. 46/1974 reversing the Judgment and decree of the Court of the Munsiff, Muddebihal, in O.S.No. 108/1959.2. The original suit was filed by the plaintiffs for recovery of possession of the suit lands bearing R.Sy.No. 102 measuring 5 acres 34 guntas of Nagaral village in Muddebihal taluk of Bijapur District on the ground that it was the property of Maruthi Deity of Nagaral village and it is the trust property and gifted in favour of Thippanna by the trustees Basappa and Narayanappa. This gift was as far back as in the year 1911 by Narayanappa and Basappa. While Narayanappa had pre-deceased Basappa, Basappa died on 1-2-1943. Thereafter, in the year 1955 i.e., in February 1955, the application came to be made to the Charity Commissioner, Bijapur, for permission to file a suit and the permission was granted. ORDER1. In all these petitions under Arts. 226 and 227 of the Constitution the petitioners have sought for quashing the resolution dated 17/18th July 1987 passed by the R., T. A. Mangalore in subject No. 147/8788 granting a temporary stage carriage permit to the 2nd respondent (M. Vitobha) on the route Kankanady to Udupi and back via Mulky with one round trip for the period from 1-81987 to 30-11-1987 to be operated by the Motor Vehicle bearing registration No. CTX. 6352 which is also attached to the pucca stage carriage permit No. 39/DK/7879 on the route Mangalore Railway Station to Manipal and back via Mangalore B us Stand, Mulky, Udupi (One round trip). To this pucca permit one more additional round trip to be operated by the very same vehicle has also been granted by the R.T.A. in subject No. 481/81-82-638 and 209/83-84 in December 1986.2.1. Kulkarni, J.1. This is an appeal by the State against the Judgment and order of acquittal dated 25th April, 84 passed by the J.M.F.C. Davangere in Criminal Case No. 1386/82, acquitting the accused of the offences punishable under Sections 279, 337, 338 and 304A I.P.C.2. The material facts are as under :On 2-12-81 Mohan-P.W.2, Ravikumar-P.W.3, Ramu-P.W.4, Babu-P.W.5 and Deenadayal-P.W.6 and the parents of Mohan-F.W.2, and his elder brother and his sisters and other relatives left Dandeli in a matador van MEZ 9472 at about midnight for the purpose of going to Virudhunagar where the marriage of P.W.6 was to be performed on 7-12-81 The said van left Dandell at 12 midnight.
