This is an appeal brought on behalf of the Additional Commissioner of Income-tax, Karnataka, and the First Income-tax Officer, Mangalore Circle, Mangalore, against the order made in W.P. No. 597 of 1973 (A. L. N. Rao Charitable Trust v. Addl. Commissioner of Income-tax) by Venkataramiah J. by which the learned judge allowed the writ petition filed by the respondent herein and directed the Commissioner of Income-tax to dispose of the proceedings initiated by him under section 263 of the Income-tax Act, 1961, hereinafter called 'the Act', in the light of the interpretation of section 11 of the Act made in the said order. The relevant facts in brief are : Respondent, A. L N. Rao Charitable Trust, Mangalore, is a charitable trust. ORDERM.S. Nesargi, J.1. This revision petition has been registered suo motu in exercise of the powers of this Court under Sections 397 and 401 of the Code of Criminal Procedure.2. The few facts necessary to understand the question involved may be narrated as follows:The prisoner in question is Mahadevappa Sidramappa Bokkasad undergoing imprisonment in Central Prison, Belgaum. He was on 31-7-1963, convicted by the I Additional Sessions Judge, Dharwar, in Sessions Case No. 12 of 1963 for having committed an offence punishable under Section 302, I. P. C, and sentenced to undergo imprisonment for life. He was again tried by the II Additional Sessions Judge, Belgaum, in Sessions Case No. 145 of 1974 for having committed an offence punishable under Section 307, I. P.C. The II Additional Sessions Judge, Belgaum, pronounced his Judgment on 21-12-1974 convicting him for the said offence and sentencing him to rigorous imprisonment for one year. ORDER1. The dispute involved in this writ petition relates to a land bearing Sy. No. 51 (old) 63 (new) situated in Hosahalli village, Koppal Taluk. The said land originally belonged to one Panumanthappa son of Anateppa Mulimani. The petitioner purchased it in the year 1965. It had been leased in favour of the first respondent and he was in possession of it. The petitioner claiming to be the purchaser of the land dispossessed the first respondent in 1967. The first respondent filed an application before the Land Tribunal, Koppal in 1968 stating that he had been dispossessed by the petitioner illegally and praying that the Tribunal might direct redelivery of the land to him. The said application was made under Section 41 of the Karnataka Land Reforms Act (hereinafter referred to as the 'Act' ) as it stood then.
