The petitioner who was a conductor in the Mysore State Road Transport Corporation was dismissed by the Divisional Controller of the Mysore Division of that Corporation on charges of misconduct. The appeal preferred by the petitioner to the General Manager was dismissed.2. In this writ petition in which we are asked to quash the orders made by the Divisional Controller and the General Manager, Mr. Shivaramiah raised the contention that under the standing orders as they stood on October 29, 1964, when the petitioner was dismissed, an order of dismissal should be preceded by an independent enquiry by the Deputy General Manager of the Corporation in the Bangalore Division but that no such independent enquiry was conducted by that Deputy General Manager.3. Gopivallabha Iyengar, J.1. The petitioner made an application for the grant of 3 acres of land in what he refers to as Survey No. 288 of Kadidalvillage, Mandya Taluk. This application was made for the reason that one acre of his land in survey No. 185 of the same village had been acquired. This application was made in November 1956. The 3rd respondent raised objections to this grant stating that on his application for the grant of 2 acres of land on 18-6-1948, an order had been made by the Government granting 2 acres in Block B out of survey No. 179 of the same village.The contention was that the land granted to him was the same as the one for which the petitioner had made the application in November 1956 under the document a copy of which is marked Ex. B in this case. The Tahsildar rejected this petition on 15-7-1959. On appeal, the Assistant Commissioner remanded the matter in order to ascertain the identity of the land which was in question. On December 18, 1963 the Mysore State Road Transport Corporation established under the Road Transport Corporation Act, 1950, which will be referred to in the course of this judgment as the Corporation, published a scheme which it had prepared under Section 68-C of the Motor Vehicles Act. This scheme appeared in the gazette bearing the date January 2, 1964, but on account of a technical defect it was withdrawn and on October 8, 1964 another scheme was published. Both schemes related to certain routes in the districts of Kolar and Bangalore Objections were produced to the approval of the scheme. But by an order made by the Chief Minister under Section 68-D on January 10, 1968 has accorded his approval to the scheme with minor modifications.2.
