ORDERS.J. Mukhopadhaya, J.1. The petitioner has challenged the Notification Nos. Ru-De-4(Sta)-389/2,001-3377 and Ru-De-4(Sta)-389/2001-3351, dated 29th June, 2005, whereby and whereunder, he has been transferred from the post of Assistant Engineer, Rural Development (Special Division), Hazaribagh to the post of Assistant Engineer, Rural Development (Special Division), Palamau.2. The main grievance of the petitioner was that the notifications of transfer were issued not on the recommendation of any Establishment Committee but for some other consideration. 3. The case was earlier taken up and notice was issued on 6th respondent, Md. Alimuddin, who was posted in place of petitioner 6th respondent has already appeared.4. In this writ application the petitioner has challenged the Statement of Account of Superannuation Benefits Fund wherein petitioner's date of superannuation has been mentioned as 22.8.2003 assuming the date of birth of the petitioner as 22.8.1943.2. The petitioner joined the service of the respondents on 22.08.1973. The date of birth of the petitioner, was recorded as 2.4.1951 (22 Years). Hence the date of superannuation was fixed as 22.08.2009. The petitioner was performing his job as crane operator. In all the papers maintained by the respondent-Management the date of birth of the petitioner was entered as 2.04.1951. In the Medical Book issued in favour of the petitioner and also in the LTC/LLTC the date of birth of the petitioner has been mentioned as 2.04.1951. These two appeals arise out of two writ petitions, being CWJC No. 6138 of 1996-R and CWJC No. 4803 of 1997-R, disposed of by a common judgment dated 24th June, 2003, passed by a learned Single Judge of this Court.2. The respondents in CWJC No. 6138 of 1996-R had invoked the provisions of the Industrial Disputes Act, 1947, for regularization of their services. According to the said respondents, they were all workmen appointed between the years 1980 to 1983 on daily wages under the Executive Engineer, Water Resources, Irrigation Department, Irrigation Division, Deoghar in various capacities, such as chowkidars, Night Guard, Typists, Tracers, Helpers, etc. It was also their case that they had continuously rendered service as permanent staff, but had not been given the benefits and status of permanent employees, nor were they being paid as per the principles of equal pay for equal work.
