This appeal arises against the judgment dated 22.3.1990 passed by the Session Judge, Godda in session trial No. 64 of 1988, whereby the learned Sessions Judge convicted the appellant for the offence under Section 376 of the Indian Penal Code and sentenced him to undergo RI for a period of 7 years.2. The prosecution case, in short, is that the victim, Gyanwati Devi (PW 6) lodged FIR (Ext. 2) on 14.1.1988 at about 3 p.m. against the appellant alleging therein that on 13.1.1988 at about 4 p.m. while she was picking up cow-dung from the field of appellant, he (appellant) who was grazing his buffalo came there and threw her on the ground and then committed rape on her. In this writ application, the petitioner has prayed from direction to the respondents to pay death-cum-retiral benefits to the petitioner and also to release Rs. 30.715.80P with interest which, according to him has been illegally deducted from DCR gratuity.2. The petitioner's case is that on attaining the age of superannuation he retired from service as Assistant Electrical Engineer on 31.01.2001 from Tupudana, Ranchi. After his retirement he was not paid retiral benefits. For that he had to move this Court in W.P.(S) No. 2737 of 2002. The said writ application was disposed of and the petitioner was paid his retiral benefits, but by letter No. 797, dated 22.3.2002 the respondents deduced a sum of Rs. 30.715.80P out of the amount of D.C.R. gratuity amounting to Rs. 1,26,142.00. ORDERN.N. Tiwari, J. 1. This Second Appeal by the defendant/appellant/appellants is against judgment and decree of affirmance dated 30.7.1999 passed by the 3rd Addl. District Judge, Dhanbad upholding the judgment and decree of the trial Court. The plaintiff filed Title Suit No. 57/97 praying for declaration that his date of birth recorded in the Matriculation Certificate, as 17.7.1944, is correct and genuine and the date of birth entered in the Service Book is incorrect and be corrected as 17.7.1944.2. The plaintiffs case is that he had passed matriculation examination from Bihar School Examination Board in the year 1961 and in the certificate his date of birth was recorded as 17.7.1944.
