Bro. Cyril K. Chettiath and ors. Vs. State of Jharkhand

Court: Jharkhand

Reported in: [2003(1)JCR515(Jhr)]

ORDERTapen Sen, J.1. Heard Mr. A.K. Sahani, learned counsel for the petitioner and Mr. Shamim Akhtar, learned SC-II.2. The grievance of the writ petitioner in the instant case is that notwithstanding the earlier judgment of the Patna High Court passed in CWJC No. 8004 of 1998 (Annexure 8) by which a specific direction had been made to decide the issue once and for all, and also notwithstanding the release of, funds by the Jharkhand Government as is evident from Annexure 9, which is a letter dated 30.3.2001, the petitioners have not yet been paid their interim relief since October 1999 and also arrears, teaching allowances, regional allowances and other benefits.3. It appears that by judgment of the Patna High Court passed on 4.1.2000, it was inter alia indicated that the State Government by a resolution had decided to give medical allowance, house rent allowance etc. to the employees of the recognised Govt. aided Minority Schools at par with the employees of taken over Government Schoo...

Ram Prakash Sharma Vs. B.S.R.T.C. and ors.

Court: Jharkhand

Reported in: [2003(1)JCR518(Jhr)]

ORDERTapen Sen, J.1. Heard Mrs. Jaya Roy,learned counsel for the petitioner and Mr.P.P.N.' Roy, learned senior counsel for theB.S.R.T.C.2. From a perusal of the enquiry report which was placed by the learned counsel for the petitioner it appears that the enquiry officer did not find anything against the petitioner save and except suspicion. What is interesting is that the same suspicion was also recorded in relation to the then Depot Superintendent, Divisional Manager, Junior Foremen, Chowkidar alongwith the petitioner. Surprisingly for such a mere suspicion the petitioner has been dismissed, from service and upon enquiry, Mrs. Jaya Roy states that nothing whatsoever has been done in relation to the senior officers, i.e., Divisional Manager and other officers mentioned above. Prima facie, therefore, the punishment of dismissal inflicted upon the petitioner appears to be extremely harsh and that too when the charge relates to the missing of an alternator and one micro self starter. It i...

The petitioner, a petty peon working in the Bermo Mines of Damodar Valley Corporation was veritably shocked when he learnt through a 'Retirement Forecast' as contained at Annexure 2 that he would be superannuated on and from 31st December, 1997 contrary to his own record and contrary to his own date of birth which according to the petitioner was actually 21.7.1942 which logically would have taken him to 21.7.2002 before he actually would have superannuated. Being aggrieved by the aforementioned retirement forecast, the petitioner protested whereafter a medical board was constituted by the Management themselves and the petitioner was asked to appear. Subsequently the medical board examined the petitioner and found him to be actually less in age and therefore an office order was subsequently issued on 27.7.1998 (Annexure 4) by reason whereof the date of ...
