Bhat, J., dismissing the petition of the appellant, a barking company registered under the Indian Companies Act, under Section 103 and 104 of the Constitution of Jammu and Kashmir for issue of a writ of certiorari to quash the award of the labour court, Jammu, dated 30 November 1986, in an industrial dispute between the appellant and respondent 2 published in the Jammu and Kashmir Government Gazette, dated 15 December 1986, and for a writ of prohibition to restrain respondent 1 from enforcing the said award. The facts giving rise to this appeal are: By a letter appointment, dated 23 January 1985, issued by the Chief Agent, the Central Bank of India, Ltd., Amritsar, respondent 2 was appointed as a clerk in the Jammu branch of the appellant on probation cash order equivalent to one month's salary in lieu of notice served on the said respondent.
