In this writ petition the petitioner Punjab State Electricity Board is aggrieved against the award of the Presiding Officer, Labour Court, Himachal Pradesh at Shimla in case No. 157 of 1987 dated August 9, 1991 (Annexure P-12) and letter dated March 3, 1992 (Annexure P-13) issued by Labour Commissioner, Himachal Pradesh requesting the Petitioner to implement the award and in default thereof recovery certificate would be issued in respect of the claim of the workman under Section 33(C) of the Industrial Disputes Act, 1947.2. The facts on which there is not much dispute are the following : -'Punjab State Electricity Board ('The Board' hereinafter) is a statutory body constituted under the Electricity Supply Act, 1948. S.N. Phukan, C.J. 1. This appeal is directed against the guard of the Commissioner under Workmen's Compensation (SDM). Mandi. dated October 29. 1991 is File No. II of 1991.2. Admittedly, one Charanji Lal. who was about 18 years old was working as a conductor under respondent No. 1 in his truck No. HID 1961. The truck met with an accident on September 19 1990 and a claim under Workmen's Compensation Act. 1923 was filed before the Commissioner. By the impugned award. Commissioner awarded, taking into consideration the income and age of the deceased, a sum of Rs. 81,496/- with further direction that in case of failure to deposit the amount within one month, interest at the rate of 20 per cent on the above amount shall be payable. The insurance company, namely, respondent No. 2 was saddled with the compensation as well as the interest.3.
