No. 19 of 1985 with Cross-Objection No. 153 of 1985, F.A.O. No. 56 of 1985 with Cross-Objection No. 40 of 1986, F.A.O. No. 57 of 1985 with Cross-Objection No. 188 of 1985, F.A.O. No. 58 of 1985 with Cross-Objection No. 41 of 1986, F.A.O. No. 59 of 1985 and F.A.O. No. 60 of 1985.2. F.A.O. No. 56 of 1985 has been filed by the insurance company against the award. The claim petitioner-respondent Renu Acharya filed the claim petition under Section 110-A of the Motor Vehicles Act, 1939 (hereinafter called as 'the Act'), on the death of her husband Surendra Acharya, who died in the accident on 24.2.1980. By this common judgment, we dispose of two appeals, registered as FAO (WCA) No. 91 of 987 and FAO (WCA) No. 92 of 1987 and also Cross-Objections No. 88 of 1989 filed in FAO NO. 92 OF 1987.2. The appeal, registered as FAO (WCA) No. 91 of 1987 has been filed by the Insurance Company against the Award dated June 30, 1987 in case No, 3/85, of the Commissioner, Solan, under the Workmen's Compensation Act. The claim petition was filed by Smt Nako alias Naiku Devi widow of deceased Tulsia Ram and two minors, namely Miss Devkoo Devi and Master Narayan Dass. Deceased Tulsia Ram was employed by respondents Nos 1 and 2, namely, Dhani Ram son of respondent No. 2 Devi Ram, who are the owners of Truck No. HPA 1277. The truck was driven by deceasd Ram Lal. S.N. Phukan, C.J.1. The writ petitioner, who is an employee of the respondent Bank, was put under suspension on September 28, 1989 vide copy of the letter at Annexure PA. After more than five years, when no departmental action was taken out, the petitioner moved this court by way of a writ petition which was registered as C.W.P. No. 603 of 1993. It may be stated that two officers of the respondent-Bank, namely, Vijay Kumar Sharma and Dinesh Gupta were also put under suspension on the same charges. These two officers also filed writ petition which was registered as C.W.P.No. 1299 of 1993.2. In the meantime Central Bureau of Investigation, after recording formal first information report with respect to the same charges under which the present petitioner was suspended had initiated proceedings and after completion of investigations a challan was submitted under Section 173, Cr.
