This appeal arises out of the judgment of Sessions Judge, Chamba, in Sessions Case No. 12 of 1989 by which the accused before us have been convicted Under Section 302 read with Section 34 of the IPC and sentenced to rigorous imprisonment for life.2. The prosecution case may briefly be stated thus. The accused are residents of village Ludhera. The deceased, Mahesh Dass, was the husband of accused Vidya Devi. The deceased had four children, namely, Roshan Lal (P.W. 1), Raj Kumari, Kumari Rekha (P.W. 6) and Narain Dass. Raj Kumari has also been joined as accused in this case. However, she being a child, her, trial is pending before the children Court at Una.3. According to the prosecution, the deceased and accused Vidya Devi were not having good relations and for about a year before the incident, she had been living at her parents house along with Narain Dass, Rekha and Raj Kumari. The State of Himachal Pradesh, defendant in a suit (No. 114/1 of 1988) filed by the plaintiff-respondent, in the court of Sub Judge, Bilaspuron February 17, 1988. has approached this court for redress against an order of the learned Sub Judge dated February 8, 1991, in the present revision petition under Section 15, C.P.C.2. For various reasons, which need not be recounted, the suit has remained undecided, so far. However, what is relevant for the disposal of this revision is the fact that some witnesses summoned by the plaintiff included the Chief Secretary to the Government of Himachal Pradesh as also the Financial Commisioner-cum-Secretary (Revenue) of that Government. V.P. Bhatnagar, J.1. Petitioner Munna Lal has filed this writ petition under the provisions of Articles 226/227 of the Constitution of India. The averments made in the petition are that his eldest son Rakesh Kumar was married to Smt. Santosh daughter of Sham Lal in the month of October 1990. The petitioner had gone to Uttar Pradesh on February 4, 1991 where he got the information from his brother-in-law that Rakesh Kumar had died. He rushed back. Jagdish Chand accused has challenged the judgment dated 1-12-1988 passed by the Sessions Judge, Kangra Division at Dharamshala whereby he has been convicted under Section 333, IPC and sentenced to rigorous imprisonment for four years and also to fine of Rs. 2,000/-. The landlords initiated proceedings under Section 14 of the Act before the Rent Controller, District Sirmaur at Paonta Sahib seeking ejectment of the tenants on the ground that the tenants were in arrears of rent from July 1, 1986 till the date of the filing of the petition, namely, Nov. 14 1986. The landlords claim that the rent for the shop was payable at Rs. 450/- per month.
