H. S. Thakur, J.1. In CWDs 304 and300 of 1982, common questions of law and fact are involved. As such, both these CWDs can conveniently be disposed of by a common judgment. It may be pointed out that these writ petitions are being disposed of peremptorily as the same are likely to be rendered in-fructuous in case the timber is not sold, and, if necessary, transported to other places within the State or outside the State by 30th Nov., 1982.2. The undisputed facts are that the petitioners applied for the marking and felling of trees standing on the areas owned by the petitioners-owners, and granting permission, for export of timber in favour of petitioners 1 and 2. The Government has produced the relevant record in the court. V.D. Misra, C.J. 1. The Himachal Pra-desh Medical College, Simla (referred to as the college), provides a course of study for M. B. B. S. degree of the Himachal Pradesh University (referred to as the University). The prospectus of the College issued for 1982-83 for 'under-graduate (M. B. B. S.) course mentions in detail the method of admission. A total of 65 seats are available. These are divided into two groups. Under group 'A' fall the reserved seats which are 34 in number. Three seats are reserved for candidates whom the Chief Minister may nominate at his discretion. One seal is reserved for 'children of Defence personnel posted in H. P.' Group 'B' relates to unreserved seats which are 31 in number. Though the minimum qualifications of eligibility are laid down, admissions are made on the basis of a competitive examination, known as the 'Pre-Medical Test' (P. M. T.) conducted by the University. ORDERH.S. Thakur, J.1. The petitioners were convicted by the Chief Judicial Magistrate, Sirmur District, on 18th May, 1982 for an offence under Section 7/16 of the Prevention of Food Adulteration Act and sentenced to undergo rigorous imprisonment for one year each and to pay a fine of Rs. 2.000/- each and, in default of payment of fine, to suffer further rigorous imprisonment for a period of one month each. The petitioners preferred an appeal against the said order of conviction and sentence. The learned Additional Sessions Judge, Solan and Sirmur Districts, however, dismissed the appeal on 10th Sept. 1982. Aggrieved by the said order and judgment, the petitioners have preferred this revision petition in this Court.2. The relevant facts may be stated. Kishan Sarup Thaper Vs. Dr. Lakhbir Sood and ors.

Misra, C.J.1. Mr. Kishan Sarup Thapar, advocate of Chandigarh, was engaged by Mr. Amrit Lal Sood in a case pending in the High Court at Simla. The date of hearing was Augsut 25, 1970. Mr. Amrit Lal borrowed Car No. DLE-5220 from his brother-in-law, Mr. Lakhbir Sood, for going to Simla. He took Mr. Thapar and proceeded to Simla. The car was beingdriven by Mr. Amrit Lal. At 7.05 a.m. the car met with an accident with truck No. HRA-606 near post office at Kandaghat. Mr. Thapar was injured and was removed to Snowdon Hospital, Simla. He was found to have fractured his right shoulder and left hip bone. He remained in the hospital till August 31, 1970. Thereafter, he was removed to Chandigarh in an ambulance and had to remain in bed till 4th or 5th October, 1970. The doctor was of the opinion that Mr. Thapar would lead a stiff shoulder as its movements in extreme degrees would not be possible.
